Covert Recordings
Recently we have had many inquiries about secret and covert recording, especially in the area of infidelity and cheating partner type investigations. Here is the bottom line!:
We/you can not record conversations in New York State, unless you/we are part of that conversation. This pertains to New York and other states that are "one party" states. In some states, BOTH parties need to consent to the recording.
In New York, if you are not part of the secretly recorded conversation, you are committing a class E felony.
Simply put, this means no phone taps or secreting a recorder in your spouses vehicle. No voice activated recorders left in the home, etc, no listening in on a conversation covertly.
The next question to be answered; What about nanny cams or other hidden video?
If video is used, you can not have audio recording active.
Many people question or disagree, but privacy concerns are the reason for theses laws!
So, based on these facts, please do not ask us to break the law! We will not do it, no matter how many times or ways you ask.
